STAMPiD Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the STAMPiD application and related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and STAMPiD. Your continued use of the Service after any changes to these Terms constitutes acceptance of the updated Terms.

2. Service Description

STAMPiD is a timestamping service that creates cryptographic proofs of file existence at specific times. The Service allows you to:

• Generate SHA-256 cryptographic hashes of your files on your device
• Submit those hashes to independent RFC 3161 Timestamp Authorities for certified timestamps
• Anchor hash proofs to the Bitcoin blockchain via OpenTimestamps
• Export evidence bundles for legal and archival purposes

Important: We process cryptographic hashes of your files, not the files themselves. Your original files never leave your device.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years of age to use the Service. If you are located in the European Economic Area (EEA), you must be at least 16 years of age. By using the Service, you represent and warrant that you meet the applicable age requirement.

4. Subscription Terms

STAMPiD offers auto-renewable subscriptions managed through Apple's App Store. By subscribing, you agree to the following:

1. Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
2. Auto-Renewal: Your subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
3. Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period.
4. Managing Subscriptions: You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
5. Subscription Tiers: STAMPiD offers three tiers:
   • Free -- 5 stamps per month
   • Creator -- 50 stamps per month, plus additional features including watch folders and evidence PDF export
   • Studio -- 250 stamps per month, plus team seats, priority support, batch stamping, and API access
6. Refunds: No refunds are provided except as required by applicable law or Apple's refund policies. Refund requests should be directed to Apple.

5. Acceptable Use

You agree not to use the Service to:

• Engage in any activity that violates applicable local, state, national, or international laws or regulations
• Abuse, disrupt, or interfere with the Service or its infrastructure
• Circumvent or attempt to circumvent usage quotas, rate limits, or other service limitations
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application
• Use automated tools, bots, or scripts to interact with the Service without our prior written consent
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

Your Content: STAMPiD does not claim ownership of your files, data, or any content you submit to the Service. The cryptographic hashes and timestamps generated by the Service are provided for your benefit.

Our Property: The STAMPiD name, logo, application, website, and all associated intellectual property are owned by STAMPiD. You may not use our trademarks, logos, or brand assets without our prior written consent.

Open Protocols: Timestamps anchored to public blockchains use open protocols (OpenTimestamps, RFC 3161) and are not proprietary to STAMPiD.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

STAMPiD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.

Timestamps as Evidence Aids: Timestamps and cryptographic proofs generated by STAMPiD are intended as evidence aids. They are not legal guarantees and should not be relied upon as the sole basis for legal claims. The admissibility and weight of timestamp evidence may vary by jurisdiction.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STAMPID'S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT OF SUBSCRIPTION FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Termination

Either party may terminate this agreement at any time:

• By You: You may delete your account at any time through the app settings or by contacting us at legal@stampid.tech.
• By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive behavior, or if required by law.

Upon termination:

• Your access to the Service will be revoked
• Your account data will be deleted in accordance with our Privacy Policy
• Cryptographic proofs that have been anchored to public blockchains (such as Bitcoin) will remain on those blockchains permanently, as they are part of an immutable public ledger

9. Privacy

Your use of the Service is also governed by our Privacy Policy, available at https://api.stampid.tech/privacy. The Privacy Policy describes how we collect, use, store, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms at this URL
• Updating the "Last Updated" date at the top
• Sending an email notification for significant changes

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts of competent jurisdiction within the United States.
